As of early 2026, only a small minority of U.S. jurisdictions have enacted statutes authorizing electronic wills. Most states still require traditional paper wills.
Based on a practitioner summary published shortly after enactment of New York’s statute, the following jurisdictions have enacted electronic wills legislation (listed alphabetically):
- Arizona
- Colorado
- Florida
- Idaho
- Illinois
- Indiana
- Maryland
- Minnesota
- Missouri
- Nevada
- New York
- North Dakota
- Oklahoma
- Utah
- Washington
Note: Enactment does not mean uniformity. Statutory requirements vary significantly by jurisdiction, including execution formalities, witnessing rules, custody, and probate treatment. This post addresses enactment status only.
