NY EPTL 7-2.2: When Estate of Trustee Ceases

EPTL 7-2.2 governs what happens to a trustee's legal title once the purpose of an express trust has been fulfilled or otherwise comes to an end.

EPTL 7-2.2 states:

§ 7-2.2. When estate of trustee ceases.

When the purpose for which an express trust is created ceases, the estate of the trustee also ceases.

Notes

For example, a trust created to manage assets during the settlor's lifetime typically states that its purpose ceases at the settlor's death. When that happens, EPTL 7-2.2 ends the trustee's estate — the trustee's legal title to the trust property — at the same moment, without any further act required.
