The Trusts and Estates Law Section (TELS) of the New York State Bar Association has weighed in on the Sixth Report of the EPTL-SCPA Legislative Advisory Committee. Among the key topics is the duty of impartiality, which requires trustees to manage and administer trust property fairly for all beneficiaries. TELS supports the proposed Section 7-A-8.3 and recommends adding “otherwise administering” to ensure the duty explicitly extends to all administrative functions.
