I recently learned on the New York State Bar Association's Trusts & Estates Law Section's listserv about the difference between filing and recording documents in Surrogate's Court:
- Filed documents merely went into the file jacket in the Record Room.
- In contrast, recorded documents appeared in bound books in the Record Room.
Over time, when documents started being scanned, the distinction between filing and recording decreased. Now, with e-filing, the distinction has lost all meaning.
